Why refusals happen
These are general patterns, not an assessment of any case:
- The duties don’t read as the listed profession.
- The credential doesn’t match the list, or the evidence is missing.
- The letter is vague about duties, dates or pay.
- The officer isn’t satisfied the stay is temporary.
- The arrangement looks like self-employment.
- Answers are inconsistent with the documents.
- A separate ground of inadmissibility applies, such as a criminal record.
What can happen at the counter

| Refused, then return | You’re not admitted in TN status and return to Canada (or don’t board, at preclearance). |
| Withdrawal of application | CBP may, at its discretion, let you withdraw your application for admission and depart, usually recorded on Form I-275. It’s generally a less serious outcome than removal. |
| Expedited removal | An order of removal issued without a hearing, typically where there are serious problems such as misrepresentation. It carries a five-year bar on returning. Findings of fraud or misrepresentation can carry a permanent bar unless a waiver is granted. |
This is why telling the truth matters so much. A weak application can be fixed. A misrepresentation finding is very hard to undo.
What gets recorded
CBP records the outcome, and you may be given forms such as the I-275 (withdrawal) or a record of a sworn statement. Keep anything you’re given and write down the officer’s reasons as soon as you can. Future crossings may involve more questions, and officers at any port can see the history.
Before trying again
- Understand the concern. Was it the duties, the credential, the letter, or intent?
- Fix the underlying issue with accurate information: a clearer letter, missing credential evidence, corrected inconsistencies. Never change facts to fit a category.
- Get independent legal advice, especially after a withdrawal or any removal. A U.S. immigration lawyer can review what happened and the options, including whether your employer should file with USCIS instead.
- Don’t port-shop. Trying another crossing doesn’t erase the record, and a second attempt will likely get closer scrutiny.

Can I reapply after being refused TN?
