What the TN list requires

L.L.B., J.D., L.L.L., B.C.L., or Licenciatura Degree (five years); or membership in a state/provincial bar.

The “or” matters: the quoted routes are alternatives, not a demand to hold every credential. Copy the credential exactly from the documents you actually hold; do not add an alternative the entry does not name.

The named degree route is “L.L.B., J.D., L.L.L., B.C.L., or Licenciatura Degree (five years)”. The “(five years)” parenthetical attaches to Licenciatura Degree.

What to explain at the counter

  1. Describe professional-level work using the employer’s real responsibilities.
  2. State the temporary period requested, up to three years, with actual start and end dates.
  3. Keep the letter, résumé, offer details and interview answers consistent.

Never add, inflate or reword duties to fit a category. Every line in the letter should be something your employer will confirm and you can describe in your own words at the counter.

Job titles that draw questions

Titles such as Paralegal, Legal Assistant, Legal Secretary, Notary Public can describe support work or another occupation. Keep the real title and describe the responsibilities honestly. TNPath’s wording flags are prompts for review, not USCIS category rulings.

TN and bar admission are separate

TN status does not admit you to any state bar. This guide covers the TN packet only — the employer letter, credential proof and documents. Questions about whether a role is the practice of law, or about bar admission, are for a U.S. immigration lawyer and the relevant state bar.

Common questions

Which degrees does the Lawyer entry name?

The entry names L.L.B., J.D., L.L.L., B.C.L., or Licenciatura Degree (five years). The parenthetical “(five years)” follows Licenciatura Degree; do not move it to the other named degrees.

Is bar membership an alternative to a named degree?

Yes. The list entry separately names membership in a state/provincial bar after “or”. Present the credential you actually hold, with the exact issuing body or bar name.

Does TN status admit me to a U.S. state bar?

No. TN status does not admit you to any state bar. Questions about authorization to practise and bar admission belong with the relevant state bar and a U.S. immigration lawyer.

As a Canadian, do I need a TN visa before I go to the border?

No. Canadian citizens are visa-exempt and apply for TN status directly at a U.S. port of entry or airport preclearance, with their documents in hand. The officer decides at the counter. People still search for "TN visa", but for Canadians it's a status granted at entry, not a visa stamp.
